1. Who we are?

1.1. We are Hire Platform which is operated and owned by Individual Entrepreneur Bondarchuk Ivanna Konstyantinivna who is the data controller and the personal data manager  in accordance with the Constitution of Ukraine, the Law of Ukraine "On Protection of Personal Data", international treaties of Ukraine, the consent of which is provided by the Verkhovna Rada of Ukraine, and EU General Data Protection Regulation 2016/679 ("GDPR").

1.2. By creating an account, User confirms that he / she agrees to the collection, using and processing of personal data in accordance with the aforementioned legislation, even though the User may be a resident of a non-European Union country and / or is not a resident of Ukraine.

2. What does this Privacy Notice governs? 

This Privacy Notice explains the kinds of data we collect when you are using HIRE Platform. This document applies to users of HIRE Services anywhere in the world. We comply with privacy laws. 

Therefore, before using the HIRE Website or the HIRE Services, any person is required to read this Policy and, in the event that any of the provisions of the Policy are not acceptable, not to use the HIRE Website or the HIRE Services in the future, or to seek additional information for such contacts: [email protected]

2.1. This Privacy Notice applies to: HIRE Platform, customer and technical support and any other services in relation to HIRE Platform we provide to you (Hereafter, the term "HIRE Services" will refer to all of these elements).

2.2. Privacy Notice  specifically applies to:

• Candidates: users, that are looking for a job. Candidates may publish their premade resumes or create new ones using HIRE Platform. 
• Employers: users, that are offering jobs by publishing vacancies and searching for potential employees from the list of available Candidates.
• Recruiters: users, that are presenting Candidates for Employers by providing resumes and/or Candidate profiles for Employers’ evaluation.
• Users: collective name of Candidates, Employers, Recruiters, and ones who browse the Hire Platform without registration.

2.3. Privacy Notice governs personal data and non-personal data, which we collect from you when you're using HIRE Services. ("Personal data" means data, which, on its own or in combination with other data, can be used to identify you).

2.4.We respect your right to privacy and will only process personal data in accordance with this Policy, the User Agreement and the applicable law in clause 1.1. this Policy.

3. How do we treat minors?  

HIRE Website and HIRE Services are not intended for persons under the age of 18, without  prior permission from their parents or other legal representatives to use  HIRE Website and HIRE Services. If a person under the age of 18 uses HIRE website and or HIRE services, the responsibility for the person's actions lies with his or her parents or legal representatives.

3.1. HIRE doesn`t provide services to persons under 18 years of age. We do not collect and will not knowingly collect personally identifiable information from any minor (under 18 years of age). If you are the parent or legal representative of a minor and have a suspicion that the person provided personal information prior to reaching the age of 18 without your permission, please contact us: [email protected].

If we will aware from parents or legal representatives of the person (we will need to provide written confirmation of legal significance, the above-mentioned connection with the person) that she/he is under 18, and she/he provide to us with personal data without the permission of her parents or other legal representatives, in this case we remove her personal information from the HIRE Web site and cease providing HIRE services to her/him within three business days of receiving such information from her/his parents or her/his legal representatives.

4. What data do we collect? 

When you use our services, we collect data about you and your activity. The data we collect is divided into four categories: data you provide, data collected automatically upon interaction with the HIRE Platform, data we collect using cookies and similar technologies and the data we received from other sources.

Data listed in this section is necessary for us to provide our services. 

4.1. Data you give us. Depending on the type of account you want to register the data may vary. 

4.1.1. To register a Candidate account you need to provide: 

• General data: Full name, date of birth, country of residence, city, working area, specialization, level of proficiency, work experience, expected salary and employment type.
• Contact data: Phone number, Skype. You may also choose to provide a secondary phone number and email address. 
• Key data: Skills and tools (for example: Adobe Illustrator, HTML, CSS).
• Work experience: Role, company name, start date, end date, and responsibilities.
• Additional data: personal achievement and expectations from a job.

4.1.2. To register an Employer account you need to provide: 

• General data: Name of the company, company’s website, company’s description.
• The contact person: Full name, phone number, email address, position.

• Requisites: Details of the company.

4.1.3. To register a Recruiter account you need to provide:

• General data: Full name, photo, phone number, email address, place of work, position.
• Requisites: Details of the company.

4.2. Data collected automatically upon interaction with the HIRE Platform. Such data includes:

• IP address
• Cookies
• data about your interaction with our Platform 

4.3.  Data collected through cookies and related technologies. We use cookies and similar technologies to collect information about the pages you have viewed, the technologies of links you click and other actions you take while using our services. Cookies are small text files sent to a user's device by a website you visit. Cookies are stored in the device memory and are used to access the site (for example, a computer, a smartphone, a tablet, and any other device used to access the sites).

Cookies can be timeless (they are called persistent cookies) and stored on your computer until the user deletes them or temporary (such cookies are called session cookies), that is, they are only stored until the browser closes. In addition, cookies are divided into main (set directly by the visited site) and third-party (set by other websites). Cookie Features: When you revisit a website, the cookie data is updated; in most cases, the web browser defaults to automatically store cookies on the User's device; disabling cookies may restrict access to published material and / or the malfunctioning of HIRE services. There are the following categories of cookies: strictly necessary cookies - required to move a user through a web page, perform a site search, memorize previous user actions when navigating to the previous page in the same session, operational cookies - aggregate information about how the Website is used. This data is stored on the user's device between web browser sessions. Functional cookies - Used to save settings or configurations stored on the user's device between web browser sessions. These cookies also allow users to watch videos, participate in interviews (polls, polls) and interact with social networks. To make the experience more enjoyable when you visit the site, these cookies store the information provided by the user, increasing the effectiveness of your site interaction.

Targeted cookies - Used to provide content that may interest the user. This data is stored on the user's device between web browser sessions.

Third-party cookies and analytics services.

HIRE uses the following cookies:

• Strictly necessary cookies to ensure the proper functioning of the Website;
• Functional cookies for the legitimate purpose of storing User's preferences;
• Third-party analytics cookies for the analysis of the Website usage.

4.4. Data collected from other sources. We may collect information from other sources. 

• Social media. Through HIRE Platform you may share data with social media websites and/or use social media websites to create your account and/or to connect your account with the social media website. You control the personal information you allow us to have access to through the privacy settings on the applicable social media website and the permissions you give us when you grant us access to the personal information retained by the social media website about you. By associating an account managed by a social media website with your account and authorizing us to have access to this information, you agree that we can collect, use and retain the information provided by these social media websites in accordance with this privacy notice. Please, read the Privacy Notice of respective social media website, prior to accessing HIRE Platform. 
• Data about someone else. We allow you to provide information about someone else, only with the permission of that person, provided that they are acquainted with the HIRE Website Terms of Use and HIRE Services, including this Policy. When providing information about someone else, you take full legal responsibility for the action.

5. How do we use your data? 

The main purpose of the collection of your data is to provide you with our service. Also, we use your data for other reasons such as:

• Safety and security 
• Customer support 
• Communications from HIRE 
• Compliance with legal obligations 
• Communications among Users 
• Research and development 

5.1. Provide you with our service. We collect the data to provide you with a personalized experience. Also, to maintain and improve our services. This includes using the data to: 

• Create and update your Account.
• Verify your identity. 
• Enable you to use our Services and Platform.
• Perform operations within HIRE necessary to provide our services, such as troubleshoot software bugs and operational problems, to make data analysis, testing, research and to monitor and analyze usage trends.

5.2. Safety and security. We may use data we collect to create a safe environment for our Users. Also, to help maintain safety and integrity of our services and Users. This includes using data to:

• Conduct Moderation (validation of user-provided data to verify identity) of our Employers and Recruiters.
• Prevent, detect and combat fraud. 

5.3. Customer support. We use the data we collect to provide you with customer support services.  This includes using data to:

• Answer your questions.
• Help resolve issues in relation to our services. 
• Monitor and improve customer support.

5.4. Communications from HIRE. We may use data we collect to communicate with you about our services.

5.5. Compliance with legal obligations. We collect your data to comply with our legal obligations. Also, we may use your data we collect to investigate or address claims or disputes in relation to the usage of HIRE Platform and HIRE Services.

5.6. Communications among Users. We use data we collect to provide our Users with a communication feature within our Platform. 

5.7. Research and development. We may use data we collect for the purpose of testing, analysis, research and overall development of the product and services. This also allows us to enhance safety and security, develop new features. 

6. What are the grounds of data collection? 

We have grounds for collection and processing of your data. We use the following grounds to collect and process your data:

• Performance of a contract.
• Comply with legal obligations.
• Legitimate interest of other persons or parties and public interest.
• Our legitimate interest.
• Your consent. 

6.1. Performance of a contract. The contract in this Policy refers to the provisions of this Policy, the User contract Agreement, these documents are the terms of use of the HIRE Web site and the HIRE Services and constitute the contract to join (a contract that can only be concluded by joining the User to the proposed agreement as a whole). The conclusion of the contract is to register an account. We need to process your information to give you access to HIRE's website and HIRE services.

• Data which you provide to register your HIRE Account is necessary for the establishing and maintaining of the Account. This also includes, verification of your identity, enabling communications with you about your usage of the Platform and providing you with internal messages and other features.
• Geolocation data is used to optimize the search engine, so that you will see relevant profiles in your area.
• Data about your interaction with our Platform is used to send you notification about jobs that might interest you

6.2. Compliance with legal obligations. To lawfully provide our services and features we need to comply with legal obligations of the jurisdictions where we operate. 

• Legal obligations require us to collect, process, disclose and retain your personal data. We use your data to comply with legal obligations to the extent they apply to your use of HIRE Platform. 
• We may share your data with law enforcement, or in case we receive a third party request to disclose your data pursuant to a legal proceeding. 

6.3. Protection of vital interests of our Users or of the others. We may process personal data or even disclose it with law enforcement in case a threat to the safety of Users or of others. 

6.4. Our legitimate interest. We collect and use personal data to the extent necessary for our legitimate interests. This includes:

• To create a safe environment. For example, we collect the results of the moderation procedure held by the third party to prevent unverified Users to provide services through our applications. For instance, we retain data of banned Users to prevent their use of the application. 
• To prevent, detect and combat fraud in connection with the use of our services. 
• To provide customer support. 
• To inform law enforcement representatives regarding criminal acts or threats to public safety. 
• To improve our services and to develop new ones. 
• To conduct research and analysis. For example, we may analyze data to improve User experience and to improve the safety and security of our services. 
• To enforce our Terms of Service. 

6.5. Your Consent. We may collect your data on the grounds of your consent. Note, you can withdraw your consent at any time. However, in case you withdraw your consent, you will not be able to use any service or feature that require collection or use of the data which we collected on the grounds of consent. 

• Provide you with marketing materials via email.

7. How do we share and disclose data? 

Certain services which we provide require us to share your data with other Users or at your request. Also, we may share your information for legal reasons or in connection with claims or disputes. 

We may share your data when in case of business transfers of any kind.

7.1. With other Users. When you use our Platform your account will be visible to other Users, unless you choose to make your account private.

7.2. Business Transfers. We will not sell your personal data to any company or organization, but we may transfer your personal data to a successor entity upon a merger, consolidation or other corporate reorganization in which we may participate or to a purchaser or acquirer of all or substantially all of HIRE assets to which this application relates. In such event, we will notify you before your personal data is transferred and becomes subject to a different Privacy Notice.

7.3. With service providers and business partners. We may provide data to our vendors, marketing partners. For example, this includes: 

• Cloud storage providers.
• Marketing partners.

7.4. For legal reasons. We may disclose your data when it is required by applicable law, regulation, operating agreement, legal process or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns. This includes:

• Disclosing your data to law enforcement representatives, government authorities.

7.5. With your consent. We may share and/or disclose your personal data in cases where we have notified you and you have provided your consent.

8. How do we handle your data?

We will store your data on secure servers within the Mirohost.net hosting provider's network. We apply maximum effort to ensure your data is protected and well secured. 

Generally, we will store your data for as long as you use our services. In case you stop using our services, we may still use limited data about your for legal, accounting and tax reasons. 

8.1. Data storage and data protection. We will store the data we collect from you on secured servers within the Mirohost.net hosting provider's network. We implement appropriate technical and organizational measures to protect your data against unauthorized or unlawful processing, accidental loss, destruction or damage. We will take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this Privacy . If you have a reason to believe that your interaction with us is no longer secure, please, immediately notify us by contacting us in writing at [email protected].

8.2. Storage time. We need the data you provide for registering your Account to provide you with our service. We will retain such data for as long as you maintain HIRE Account. In case you will decide to delete your HIRE Account or in case we no longer need your data to provide you with our service we will delete your personal data. Unless we required to keep your data for longer period. Extended storage period applies in certain special cases, such as:

• There is a legal obligation to retain your data to fulfill our tax, audit, legal and/or accounting obligations. In such cases, we will retain the necessary data for the period required by applicable law. 
• We have a legitimate interest to prevent, detect, and combat fraud and/or to maintain the security of our Users.

9. Transparency. What are your rights and choices? 

You control the data you provide to us, that is why you have certain rights under this Privacy Notice. 

9.1.Your rights. In case you provide us with your personal data you may use your powers and exercise any of the rights described in this section. If you have any additional questions you can always send an email to [email protected] and we will do our best to support you. 

9.1.1. Access. You can request an explanation of the personal data we process about you. Also, you can request a copy of your personal data undergoing processing. 

9.1.2. Rectification. You can rectify/correct any inaccurate data about you.

9.1.3. Data portability. You have a right to receive the personal data concerning you, which you provided to us. You can make a request to transmit this data directly to another data controller in a structured, commonly used and machine-readable format. We will transmit your data directly to another controller in cases where it is technically feasible.  

9.1.4. Erasure. You have a right to be forgotten which means that we will delete all personal data that you have provided to us. Note, we may retain certain information as required by law and for legitimate business purposes permitted by law. 

9.1.5. Restrict processing. You can request us to temporarily or permanently stop processing all or some of your personal data.

9.1.6. Object processing. You can, at any time,  object to the processing of your personal data on grounds relating to your particular situation. You have the right to object your personal data being processed for direct marketing purposes.

9.1.7. Lodge complaints. You have a right to file a complaint to a supervisory authority in relation to HIRE usage of your personal data. 

9.1.8. Not to be subject to automated decision-making. You have a right to not be subject to a decision based solely on automated decision making, including profiling, where the decision would have a legal effect on you or produce a similarly significant effect.

10. How do we update this notice? 

Sometimes we can update this Privacy Notice.  We recommend you to periodically review our Privacy Notice.

10.1. Updates. From time to time we may update this notice. For example, we may need to update it for legal reasons or to reflect changes in our services. If we do so, we will make the updated Privacy Notice available in our application. Also, we will update the “Last Updated” date. In case we implement significant changes we will notify you through the HIRE Platform and through other means of communication such as via [email protected]. Note, by using our services after receiving the notification of the updates, you confirm that you read our updated notice. We strongly encourage you to periodically review this Privacy Notice  for any changes. We will make prior versions of our privacy notices available for review.
